1. Scope of Application

For all orders through our online shop by consumers and entrepreneurs, the following terms and conditions apply. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legally responsible partnership that acts in the exercise of their commercial or independent professional activity when concluding a legal transaction. With regard to entrepreneurs, the following applies: If the entrepreneur uses opposing or supplementary general terms and conditions, their validity is hereby objected to; they will only become part of the contract if we have expressly agreed to them.

2. Contracting Parties, Conclusion of Contract, Correction Options

The presentation of the products in the online shop is not a legally binding offer, but an unbinding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided for this purpose in the ordering process. By clicking on the order button, you are making a binding offer for the goods contained in the shopping cart. We will confirm the receipt of your order by email immediately after you have sent the order. We accept your offer within two days by sending an acceptance declaration in a separate email or by executing the payment transaction through our service provider or the selected payment service provider. The point in time at which the payment transaction is carried out depends on the selected payment method (see "Payment"). The relevant alternative for you depends on which of the events listed occurs first.

3. Contract Language, Contract Text Storage

The languages available for the conclusion of the contract: German, English

We store the contract text and send you the order data and our terms and conditions in text form. The contract text is no longer accessible via the Internet for security reasons.

4. Delivery Terms

In addition to the stated product prices, shipping costs are added. You can find out more about the amount of the shipping costs in the offers.

We only deliver by mail. Self-collection of the goods is unfortunately not possible.

We do not deliver to packing stations.

5. Payment

The following payment methods are generally available in our shop:

Advance payment: When selecting the payment method advance payment, we will give you our bank account details in a separate email and deliver the goods after receipt of payment.

6. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal, as described in the cancellation policy. Entrepreneurs are not granted a voluntary right of withdrawal.

7. Retention of Title

The goods remain our property until full payment. For entrepreneurs, the following also applies: We reserve ownership of the goods until all claims from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you assign all claims arising from this resale - regardless of any combination or mixing of the reserved goods with a new item - in the amount of the invoice amount to us in advance, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves, insofar as you do not meet your payment obligations. We will release the securities to which we are entitled at your request to the extent that the realizable value of our securities exceeds the claims to be secured by more than 10%.

8. Transport Damages

For consumers: If goods are delivered with obvious transport damage, please report such defects to the deliverer as soon as possible and contact us immediately. The failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance company.

For entrepreneurs: The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the freight forwarder, the carrier, or the person or institution otherwise assigned to carry out the shipment.

9. Warranty and Guarantees

9.1 Warranty Law

Unless expressly agreed otherwise below, the statutory warranty law applies. The following restrictions and shortening of deadlines do not apply to claims based on damages caused by us, our legal representatives, or vicarious agents.

The statutory limitation periods for the right of recourse according to § 445a of the German Civil Code remain unaffected. The regulations for merchants apply. According to § 377 HGB (German Commercial Code), merchants are subject to the obligation to inspect and give notice of defects regulated there. If you fail to make the notification specified there, the goods are considered approved, unless it is a matter of a defect that was not recognizable during the inspection. This does not apply if we have fraudulently concealed a defect.

9.2 Guarantees and Customer Service

10. Liability

We are always liable without limitation for claims due to damages caused by us, our legal representatives, or vicarious agents

With regard to entrepreneurs, the following also applies:

For other than damages resulting from injury to life, limb, or health, we are liable only insofar as we, our legal representatives, or other vicarious agents have violated a material contractual obligation. Material contractual obligations are those whose fulfillment is necessary for the proper execution of the contract and on whose compliance the contractual partner may regularly rely. Liability for damages that are not based on the violation of a material contractual obligation is excluded.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. Consumers have the opportunity to use this platform to resolve their disputes.

To settle disputes from a contractual relationship with a consumer or whether such a contractual relationship exists at all, we are obligated to participate in dispute settlement proceedings before a consumer arbitration board. The responsible body is the Universal Arbitration Board of the Federal Center for Arbitration e.V., Strasbourg Strasse 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in a dispute settlement procedure before this authority.

12. Final Provisions

If you are a merchant, German law applies, excluding the UN Sales Convention.

If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
